Strid om dynamiske forbudssoner: Kiting på Hardangervidda i fare

Miljødirektoratet har dessverre kommet til sin beslutning om at det ikke blir dynamiske forbudssoner for 2025, redegjort som de har skriftlig i brev onsdag 12. Februar 2024.

Vi har erfart at Statsforvalteren har utarbeidet og sendt inn egen kunnskapsrapport med kritiske vurderinger av praksisen til direktoratet. Dette underlaget har vært unnlatt journalført i vår saksbehandling på en slik måte at OKK ikke har fått anledning svare ut påstandene i rapporten. Rapporten fra Statsforvalteren ble først publisert i eInnsyn.no etter at OKK fikk muntlig informasjon om at ordningen ikke videreføres 10.desember.

Rapporten har vært skjult for oss i einnsyn.no frem til den ble publisert for offentligheten 24. desember 2024. Denne ble først imidlertid sendt til Miljødirektoratet 16.oktober 2024. Dette er i strid med god forvaltningsskikk.

Det er flere momenter og påstander i dette underlaget som ikke er tilstrekkelig faglig og faktisk forankret. Argumentasjonen til Statsforvalteren overskygger det faktum at den samlede nytten av ordningen faktisk har fått dyrene til å stå i fred og beite uforstyrret mens praksisen har vært i bruk. Dette er bekreftet i en rapport fra Statens Naturoppsyn for ordningen i 2023 og 2024.

Eksempler på argumentasjon Statsforvalteren vektlegger i sin rapport til Miljødirektoratet er:

Enkelte forbudssoner kan periodesvis ha vært for små
Påstand om dyr har blitt presset mot sør og skremt av kitere
Påstand om at kitere har hatt anledning til å kite bak forbudssonene
Påstand om at kitemiljøet selv ikke forstår vår egen interne justis med begrepet (temporary prohibited kitezone) som begrunnes med at dette oppfattes som «Fake News»

Oslo Kiteklubb erkjenner at det på enkelte områder er forbedringsområder knyttet til ordningen, men vår oppfatning er at de ikke har hatt nevneverdig betydning for at dyrene ikke har kunnet beite i fred og ro. Disse erfaringene kunne vi lett justert for 2025 sesongen. Av dyreposisjoner så ser vi at dyrene har vandret normalt uten å ha vært stresset mens ordningen har vært i drift. Dette bekrefter også Statens Naturoppsyn.

Når Statsforvalteren velger å fokusere på alle de ubetydelige ulempene i ordningen, som ikke har påvirket den betydelige nytten, oppfattes argumentasjonen samt vurderingene som lite objektive og dessverre useriøse.

Det er helt tydelig for oss at dette underlaget må ha vært avgjørende for Miljødirektoratets beslutning om å ikke videreføre de dynamiske forbudssonene for 2025 med det ønske om å ikke dele dette grunnlaget med oss under sakens behandling.

Vi er uenige i vurderingene som er gjort og bedt om et fysisk møte med Miljødirektoratet i Trondheim snarest mulig for å diskutere kunnskapsgrunnlaget som er gjort.

Vi erfarer at Hardangerviddarådet , sammen med Statsforvalteren og fylkeskommunene, utarbeidet en kunnskapsrapport om kiting på Hardangervidda høsten 2024 uten noen som helst involvering fra Oslo Kiteklubb eller andre fra kitemiljøet.

Torsdag 13. februar kl. 08:34, dagen etter at vi mottok avslaget fra Miljødirektoratet, mottok vi en e-post fra Hardangerviddarådet. E-posten inneholdt en rapport om kunnskapsgrunnlaget for kiting og en anbefaling om hvordan kiting skal foregå på Hardangervidda vinteren 2025.

Rapporten og anbefalingene er utarbeidet av Hardangerviddarådet, Statsforvalteren, fylkeskommunene og kommunene på oppdrag fra Miljødirektoratet. Kunnskapsgrunnlaget ble vedtatt av Hardangerviddarådet 6. desember, fire dager før Oslo Kiteklubb fikk muntlig beskjed fra Miljødirektoratet 10.desember om at ordningen med dynamiske forbudssoner ikke blir videreført.

Følgende vedtak ble gjort av Hardangerviddarådet, 6.des 2024:
“Hardangerviddarådet ber administrativ gruppe søke videre samarbeid med Miljødirektoratet, verneområdeforvalterne og Oslo kiteklubb for å anbefale hvor kiting kan foregå av hensyn til villrein basert på vurderingene og anbefalingene i notatet «Kunnskapsgrunnlag, vurderinger og anbefalinger – kiting Hardangervidda» vinteren 2024-25.”

Hensikten med vedtaket og e-posten fra Hardangerviddarådet er å søke samarbeid slik at Oslo Kiteklubb (OKK) skal stille seg bak rapporten og anbefalingene, til tross for at OKK ikke har vært involvert i prosessen.

To timer senere, samme dag, 13. februar kl. 10:54, har Statsforvalteren allerede distribuert anbefalingene og kunnskapsrapporten til alle næringsdrivende langs RV7 med en anmodning om at de følges.

Lørdag 14. februar publiserte Statsforvalteren en sak i avisen Hardanger Folkeblad, som du kan lese her.

Det hele fremstår som en planlagt regi fra vernemyndighetenes side, uten noen involvering fra kite-miljøet. Rapporten og kunnskapsgrunnlaget fra Hardangerviddarådet inneholder anbefalinger om hvor vernemyndighetene mener at kiting skal foregå vinteren 2025. Kunnskapsgrunnlaget er verken faglig korrekt eller vurdert av oss gjennom noen form for invitasjon til dialog. Det er flere momenter og påstander i dette underlaget som ikke er tilstrekkelig faglig og faktisk forankret. Vurderingene og anbefalingene om de foreslåtte kitesonene, og nødvendigheten av disse, er tynt begrunnet og samtidig vil de ikke fungere i praksis.

Oslo Kiteklubb har vært tydelig overfor Hardangerviddarådet og Statsforvalteren at vi ikke kommer til å stille oss bak disse anbefalingene og kunnskapsgrunnlaget. Vi reagerer sterkt på at disse anbefalingene publiseres til alle næringsdrivende og i media, samtidig som det bes om samtykke til at OKK skal stille seg bak rapporten.

Dessverre ser vi et ensidig fokus på å innskrenke rettighetene og ferdselsmulighetene til kite-miljøet, som er svært tynt begrunnet. OKK er selvsagt åpen for dialog og samarbeid, men ikke på de premissene som foreligger nå.

Oslo Kiteklubb deltok på kommunestyremøtet i Hol kommune 31. oktober 2024, hvor Statsforvalteren presenterte oppstarten av en ny forvaltningsplan for Hardangervidda.

Statsforvalteren, representert ved Kjetil Heitmann, understreket viktigheten av god dialog og samarbeid for å ivareta villreinen med de nye tiltakene som vil bli innført i hans presentasjon hvor han utdyper sitat: «Vi er pålagt å bruke myke virkemidler som dialog og samarbeid med friluftsorganisasjoner osv. før vi eventuelt benytter sterkere virkemidler». Dette budskapet ble også gjentatt på et orienteringsmøte for innbyggerne på Geilo samme dag.

Oslo Kiteklubb støtter dette budskapet fullt ut og har alltid vært opptatt av å ivareta villreinen. Vi informerte Statsforvalteren om at vi er klare for å ha en god dialog fremover.

15 dager etter kommunestyremøtet gjennomførte Statsforvalteren, ved Kjetil Heitmann, en begrenset høring om «Skaupsjøen / Hardangerjøkulen landskapsvernområde – anbefaling om kiting ut fra riksvei 7 – vinter 2024 – 2005» uten at Oslo Kiteklubb fikk anledning til å uttale seg.

I høringen la Statsforvalteren frem at de har frarådet Miljødirektoratet å godkjenne Oslo Kiteklubbs søknad om dynamiske forbudssoner for 2025. Statsforvalteren presenterte ufullstendige argumenter for hvorfor ordningen ikke kan videreføres, og unnlot å nevne at dyrene har fått stå i fred og beite uforstyrret mens ordningen har vært i bruk. Erfaringsrapportene fra Oslo Kiteklubb og SNO ble heller ikke vedlagt, noe som hindret en objektiv vurdering fra de ulike myndighetene som mottok høringen. Dette gjør at Statsforvalteren fremstår som lite redelig i saken.

Vi reagerer sterkt på to direkte uttalelser fra Statsforvalteren som anføres i dialogen fra Statsforvalteren og til mottakeren av høringen i Nore og Uvdal kommune.

Utsagn 1:
«Vi legger egentlig ikke opp til dialog med kite-miljøet, de ønsker å forholde seg til dynamiske forbudssoner i samarbeid med SNO. Men ifølge Miljødirektoratet vil de ikke videreføre denne ordningen, bl.a. fordi vi foreslår soner hvor kiting anbefales.»

Utsagn 2:
«Hvis kite-miljøet ikke følger anbefalingene, er det sterkere grunner til å bruke reguleringer i neste omgang. Men da må vi ha tilstrekkelig dokumentasjon på om dette fungerer, det vil si at SNO er ute og undersøker om det er mye kitespor videre innover vidda.»

Bakgrunnen for dialog utvekslingen mellom mottakeren av høringen i Nore og Uvdal kommune og Statsforvalteren, er at mottaker informerer til Statsforvalteren at vedkommende ikke har 100% oversikt og innsikt i temaet. Samtidig påpeker mottakeren ovenfor Statsforvalteren at det bør føres dialog med kiteforbundet.

Vi vurderer at anbefalingene fra Statsforvalteren og Hardangerviddarådet utgjør en felle for kite-miljøet. Statsforvalteren har uttalt at enda sterkere virkemidler vil bli iverksatt dersom vi ikke aksepterer anbefalingene. Å godta anbefalingene slik de står nå, vil sette en presedens for hvordan kiting blir regulert i fremtiden.

Vi reagerer sterkt på Statsforvalterens fremtoning, som tydelig viser en manglende vilje til å samarbeide med kitemiljøet. Dette er i strid med Stortingets vedtak om at friluftslivsorganisasjoner skal involveres i prosesser som angår deres fremtidige ferdselsrestriksjoner, i henhold til Stortingsmeldingen om villrein.

Per i dag finnes det ingen lovhjemmel for å regulere kiting, så i praksis kan du kite hvor du vil på Hardangervidda, så lenge du er på utmark. Det er imidlertid svært viktig at kitingen foregår ansvarsfullt, og at du opptrer som en ambassadør for å beskytte dyrelivet.

The Norwegian Environment Agency has unfortunately reached its decision that there will be no dynamic prohibited kitezones for 2025, as stated in their letter on Wednesday, February 12, 2024.

We have learned that the County Governor has prepared and submitted their own knowledge report with critical assessments of the “Dynamic Prohibited Kitezones” arrangement to The Norwegian Environment Agency. The report from the County Governor has been omitted from our case processing in such a way that Oslo Kiteklubb has not had the opportunity to respond to the claims in the report. The report from the County Governor was first published on eAccess (public journal system) after OKK received verbal information on December 10 that the practice of “Dynamic Prohibited Kitezones” will be discontinued.

The report was hidden from us on eAccess until it was published for the public on December 24, 2024. However, it was first sent to the Norwegian Environment Agency on October 16, 2024. This is contrary to good administrative practice.

There are several points and claims in this report that are not sufficiently professionally and factually substantiated. The County Governor’s argumentation overshadows the fact that the overall benefit of the “Dynamic Prohibited Kitezones” has actually allowed the animals to stand in peace and graze undisturbed while the practice has been in use. This has been confirmed in a report from the Norwegian Nature Inspectorate (wildlife patrol) for this practice in 2023 and 2024.

Examples of arguments emphasized by the County Governor in their report:

Certain prohibited zones may have been too small at times.
Claim that animals have been pushed south and scared by kiters.
Claim that kiters have had the opportunity to kite behind the prohibited zones.
Claim that the kiting community itself does not understand our internal justice system with the term (temporary dynamic prohibited kitezone), which is justified by the perception that this is ‘Fake News’.

Oslo Kiteklubb acknowledges that there are areas for improvement related to the this practice, but our perception is that they have not significantly impacted the animals’ ability to graze in peace and quiet. These experiences could easily be adjusted for the 2025 season. Based on animal positions, we see that the animals have wandered normally without being stressed while the Dynamic Prohibited Kitezones has been in operation. This is also confirmed by the Norwegian Nature Inspectorate.

When the County Governor chooses to focus on all the insignificant drawbacks of this practice, which have not affected the significant benefits, the arguments and assessments are perceived as lacking objectivity and, unfortunately, being unserious.

It is very clear to us that this basis must have been crucial for the Norwegian Environment Agency’s decision not to continue the dynamic prohibited zones for 2025, with the desire not to share this basis with us during the case processing.

We disagree with the assessments that have been made and have requested a physical meeting with the Norwegian Environment Agency in Trondheim as soon as possible to discuss the knowledge basis that has been used.

We have learned that the Hardangervidda Council (Hardangerviddarådet), together with the County Governor and the county municipalities, prepared a another knowledge report on kiting on Hardangervidda in the fall of 2024 without any involvement from Oslo Kiteklubb or others from the kiting community.

On Thursday, February 13, at 08:34, the day after we received the rejection from the Norwegian Environment Agency, we received an email from the Hardangervidda Council. The email contained a report on the knowledge basis for kiting and a recommendation on how kiting should be conducted on Hardangervidda in the winter of 2025.

The report and recommendations were prepared by the Hardangervidda Council, the County Governor, the county municipalities, and the municipalities on behalf of the Norwegian Environment Agency. The knowledge basis was adopted by the Hardangervidda Council on December 6, four days before Oslo Kiteklubb was verbally informed by the Norwegian Environment Agency on December 10 that the scheme with dynamic prohibited zones would not be continued.

The following decision was made by the Hardangervidda Council on December 6, 2024: “The Hardangervidda Council requests the administrative group to seek further cooperation with the Norwegian Environment Agency, the protected area managers, and the Oslo Kiteklubb to recommend where kiting can take place with consideration for the wild reindeer, based on the assessments and recommendations in the document «Knowledge Basis, Assessments, and Recommendations – Kiting Hardangervidda» for the winter of 2024-25.”

The purpose of the decision and the email from the Hardangervidda Council is to seek cooperation so that the Oslo Kiteklubb (OKK) will support the report and the kitezones recommendations, despite the fact that OKK has not been involved in the process.

Two hours later, on the same day, February 13 at 10:54 AM, the County Governor had already distributed the recommendations and the knowledge report to all businesses along RV7 with a request that they be followed.

On Saturday, February 14, the County Governor published an article in the newspaper Hardanger Folkeblad, which you can read here.

The whole situation appears to be a planned effort by the conservation authorities, without any involvement from the kiting community. The report and knowledge basis from the Hardangervidda Council contain recommendations on where the conservation authorities believe kiting should take place in the winter of 2025. The knowledge basis is neither professionally accurate nor reviewed by us through any form of invitation to dialogue. There are several points and claims in this basis that are not sufficiently professionally and factually substantiated. The assessments and recommendations regarding the proposed kiting zones, and the necessity of these, are poorly justified and will not work in practice.

Oslo Kiteklubb has made it clear to the Hardangervidda Council and the County Governor that we will not support these recommendations and the knowledge basis. We strongly object to these recommendations being published to all businesses and in the media, while at the same time requesting consent for OKK to support the report.

Unfortunately, we see a one-sided focus on restricting the rights and access of the kiting community, which is very poorly justified. OKK is, of course, open to dialogue and cooperation, but not on the current terms.

Oslo Kiteklubb participated in the municipal council meeting in Hol municipality on October 31, 2024, where the County Governor presented the initiation of a new management plan for Hardangervidda.

The County Governor, represented by Kjetil Heitmann, emphasized the importance of good dialogue and cooperation to protect the wild reindeer with the new measures that will be introduced in his presentation, where he elaborates, quote: ‘We are required to use soft measures such as dialogue and cooperation with outdoor organizations, etc., before we possibly use stronger measures.’ This message was also repeated at an information meeting for residents in Geilo on the same day in another meeting.

Oslo Kiteklubb fully supports this message and has always been committed to protecting the wild reindeer. We informed the County Governor that we are ready to have a good dialogue going forward.

Fifteen days after the municipal council meeting, the County Governor, represented by Kjetil Heitmann, conducted a limited consultation on ‘Skaupsjøen / Hardangerjøkulen Landscape Protection Area – Recommendation on Kiting from National Road 7 – Winter 2024 – 2025‘ without giving Oslo Kiteklubb the opportunity to comment to this hearing.

In the consultation, the County Governor stated that they have advised the Norwegian Environment Agency not to approve Oslo Kiteklubb’s application for dynamic prohibited zones for 2025. The County Governor presented incomplete arguments for why the practice cannot be continued and failed to mention that the animals have been able to stand peacefully and graze undisturbed while the scheme has been in place. Experience reports from Oslo Kiteklubb and the Norwegian Nature Inspectorate were also not included, preventing an objective assessment by the various authorities that received the consultation. This makes the County Governor appear unrighteous in the matter.

We strongly react to two direct statements from the County Governor that are cited in the dialogue from the County Governor and to the recipient of the hearing in Nore and Uvdal municipality.

Statement 1:
«We are not really planning to engage in dialogue with the kiting community; they prefer to adhere to dynamic prohibited zones in cooperation with the Norwegian Nature Inspectorate (SNO). However, according to the Norwegian Environment Agency, they will not continue this scheme, partly because we are proposing zones where kiting is recommended.»

Statement 2:
«If the kiting community does not follow the recommendations, there are stronger reasons to use regulations next time. But we need sufficient documentation to see if this works, meaning that SNO needs to be out there checking if there are many kite tracks further into the plateau.»

The background for the dialogue exchange between the recipient of the hearing in Nore and Uvdal municipality and the County Governor is that the recipient informs the County Governor that they do not have 100% overview and insight into the topic. At the same time, the recipient points out to the County Governor that a dialogue should be conducted with the Kite Federation.

We consider the recommendations from the County Governor and the Hardangervidda Council to be a trap for the kiting community. The County Governor has stated that even stronger measures will be implemented if we do not accept the suggested recommendations for kiting at Hardangervidda. Accepting the recommendations as they stand now will set a precedent for how kiting will be regulated in the future.

We strongly object to the County Governor’s approach, which clearly shows a lack of willingness to cooperate with the kiting community. This is contrary to the Norwegian Parliament’s decision that outdoor recreation organizations should be involved in processes that concern their future access restrictions, according to the Parliamentary White Paper on wild reindeer to protect them.

As of today, there is no legal basis for regulating kiting, so in practice, you can kite wherever you want on Hardangervidda, as long as you are on uncultivated land. However, it is very important that kiting is done responsibly and that you act as an ambassador for protecting wildlife.

Continue to follow the current rules for snowkiting.
Kite as usual and enjoy nature.
Show great respect and responsibility!
If you encounter or see reindeer, immediately turn in the opposite direction to avoid disturbing them! (The same applies if you see reindeer tracks, as they are likely nearby.)
Inform others about where the animals are to help them stay away.
Also report back to Oslo Kiteklubb about any incidents.
